1. Agreement to Terms

These Membership Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and Booking Club Pty Ltd (ABN 89 699 101 025), Level 3 / 55 Collins St, Melbourne VIC 3000 ("BookingClub," "we," "us," or "our"), governing your access to and use of the BookingClub website at www.bookingclub.com.au and all related services (collectively, the "Platform").

By creating an account, accessing the Platform, or subscribing to any membership tier, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Competition Terms & Conditions, Travel Booking Terms, Refund Policy, and all other policies referenced in these Terms. If you do not agree to these Terms, you must not use the Platform.

2. Definitions

In these Terms, the following definitions apply:

"Australian Consumer Law" or "ACL" means Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.

"Billing Period" means the monthly or annual subscription cycle applicable to your paid membership.

"Competition Terms" means the Competition Terms & Conditions published at bookingclub.com.au/terms/competition, which govern all promotional prize draws.

"Draw" or "Prize Draw" means a promotional prize draw conducted by BookingClub in accordance with the Competition Terms.

"Entry" or "Promotional Entry" means an entry into a Prize Draw, allocated by loyalty accrual or referral bonus. Entries cannot be purchased.

"Founding Member" means one of the first 250 paid members to subscribe to the Platform, as described in Section 6.

"Loyalty Entry" means a promotional entry automatically accrued based on a paid Member's tier and duration of continuous membership.

"Platform" means the BookingClub website, mobile site, and all related services, features, and content.

"Travel Platform Provider" means the third-party technology platform through which BookingClub provides access to travel booking services. The Travel Platform Provider is a technology company, not a travel agent, tour operator, or travel supplier.

"Travel Supplier" means the hotel, accommodation provider, or property whose accommodation is booked through the Platform, together with the wholesale accommodation supplier through whom that accommodation is sourced.

3. Eligibility

To register for a BookingClub membership, you must be at least eighteen (18) years of age and an Australian resident. By registering, you represent and warrant that you meet these eligibility requirements and that all information you provide during registration is accurate, current, and complete.

We may request verification of your age or residency at any time. Failure to provide satisfactory proof may result in account suspension or termination.

Certain membership benefits, including participation in promotional prize draws, may be subject to additional eligibility restrictions (including state or territory exclusions) as set out in the Competition Terms.

4. About BookingClub

BookingClub is a members-only travel club. Members gain access to discounted hotel pricing, sourced from wholesale accommodation suppliers through a travel technology platform, along with member-only travel deals, hotel sale alerts, and priority support. Paid members additionally receive automatic entries into periodic promotional prize draws as a benefit of their membership.

BookingClub operates promotional prize draws as a trade promotion under Australian law. The primary value of paid membership is a tiered discount on hotel rates: each paid tier receives bigger discounts on the same accommodation, delivering standalone, quantifiable savings on every booking independent of any prize draw. Member-exclusive deals, hotel sale alerts, and priority support are further benefits. Promotional prize draws are an additional benefit of paid membership, not the primary service offering.

BookingClub sources accommodation from wholesale suppliers and arranges your booking with the property. The accommodation itself is provided by the hotel or property you book, as set out in section 14 and our Travel Booking Terms.

5. Membership Tiers

BookingClub offers three membership tiers:

5.1 Tourist Membership (Free)

Tourist membership is free and provides:

  • Access to the BookingClub travel booking platform at member pricing
  • Ability to browse travel deals
  • Travel newsletter
  • Email support (response within 48 hours)

Tourist members do not receive promotional draw entries and are not eligible to win prizes in any Prize Draw. The Tourist tier includes advertising from selected travel partners. There is no fee for this tier.

5.2 Regular Traveller Membership ($24 AUD/month or $240 AUD/year)

Regular Traveller membership includes all Tourist benefits plus:

  • Bigger discounts on travel bookings than the Tourist tier (the Platform applies more favourable pricing to Regular Traveller members on the same accommodation)
  • One (1) loyalty entry per month of continuous membership into promotional prize draws, accumulating up to a cap of twelve (12) entries
  • Hotel sale alerts as soon as they are released
  • Email support (response within 24 hours)
  • Eligibility for travel insurance discounts (when available)
  • Participation in monthly promotional prize draws

The Regular Traveller tier includes advertising from selected travel partners.

5.3 Seasoned Traveller Membership ($49 AUD/month or $490 AUD/year)

Seasoned Traveller membership includes all Regular Traveller benefits plus:

  • BookingClub's biggest discounts on travel bookings (the most favourable pricing tier available on the Platform)
  • Five (5) loyalty entries per month of continuous membership into promotional prize draws, accumulating up to a cap of sixty (60) entries
  • Completely ad-free experience (no travel partner advertising)

5.4 Service Modifications

We reserve the right to modify, add, or remove features or benefits associated with any membership tier at any time. Material changes to paid membership benefits will be communicated via email and posted on the Platform at least thirty (30) days before taking effect. If a change materially reduces the benefits of your current tier, you may cancel your membership before the change takes effect.

6. Founding Member Program

The first two hundred and fifty (250) paid members to subscribe to a Regular Traveller or Seasoned Traveller membership are designated "Founding Members" and receive the following benefits:

  • Double loyalty entries in every Prize Draw (applied on top of the standard accrual rate for the Member's tier)
  • Discounted first-year annual subscription price of $188 AUD (Regular Traveller) or $388 AUD (Seasoned Traveller)

Founding Member status and the double-entry benefit apply for the duration of the Member's continuous paid membership. If a Founding Member cancels their paid membership and their paid period expires (i.e. the membership lapses), Founding Member status is forfeited permanently. Re-subscribing after a lapse does not restore Founding Member status.

Renewals after the discounted first year are charged at the standard annual or monthly price then in effect.

7. Subscription and Billing

7.1 Recurring Billing and Auto-Renewal

Paid memberships (Regular Traveller and Seasoned Traveller) are available on a monthly or annual subscription basis. Your subscription will automatically renew at the end of each Billing Period at the then-current price unless you cancel before the renewal date. Monthly subscriptions renew on the same calendar day each month (or the last day of the month if the month has fewer days). Annual subscriptions renew twelve (12) months from the initial subscription date.

7.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you agree to Stripe's Services Agreement and Privacy Policy. BookingClub does not store complete credit card numbers or sensitive payment data on our servers. By subscribing, you authorise BookingClub to charge your designated payment method on a recurring basis according to your selected Billing Period.

7.3 Billing Date

Your billing date is set when you first subscribe. Subsequent charges occur on the same day of each subsequent Billing Period. If a month has fewer days than your original billing date, billing occurs on the last day of that month.

7.4 Price Changes

We reserve the right to modify subscription pricing with at least thirty (30) days' advance notice. Price changes will not affect your current Billing Period but will apply upon your next renewal. You will be notified of price changes via email and will have the opportunity to cancel before the new pricing takes effect.

7.5 Failed Payments

If a payment fails, we will attempt to charge your payment method again. Your account may be suspended if payment cannot be processed after repeated attempts. During any suspension period, you will lose access to paid membership benefits, including promotional entries. You remain responsible for any unpaid amounts.

7.6 Taxes

All prices quoted are in Australian dollars (AUD). Where required by law, we will collect and remit Goods and Services Tax (GST) on subscription fees. You are responsible for any other applicable taxes, levies, or duties imposed by taxing authorities.

7.7 Free-Trial and Promotional Offers

From time to time we may offer a promotional free trial on a paid membership (for example, a free first month of Regular Traveller membership). To start a free trial you must provide a valid payment method. You are not charged during the free-trial period. Unless you cancel before the free-trial period ends, your membership automatically continues and your payment method is charged the applicable membership fee (for Regular Traveller, currently A$24 per month) at the end of the free-trial period, and on a recurring basis each Billing Period after that, until you cancel. You may cancel at any time before the free trial ends through your account dashboard, and you will not be charged. The date your first charge will occur, and the amount, are shown to you at sign-up and in your confirmation email. Free-trial offers are limited to one per member and are not available to members who have previously held a paid membership. Your eligibility for Prize Draws during a promotional period is governed by the Competition Terms.

8. Cancellation

8.1 How to Cancel

You may cancel your paid membership at any time through your account dashboard on the Platform or by contacting us at concierge@bookingclub.com.au. Cancellation takes effect at the end of your current Billing Period (monthly or annual). You are not required to provide a reason for cancellation, and you can cancel using the same channel through which you subscribed (online).

8.2 Access After Cancellation

You will retain access to paid membership benefits (including eligibility for Prize Draws whose entry deadlines fall within your remaining paid period) until the end of the Billing Period you have already paid for. After that date, your account will automatically revert to the free Tourist tier.

8.3 Effect on Promotional Entries

Cancelling your membership and allowing it to lapse forfeits your accumulated loyalty entry tenure. If you later re-subscribe, your loyalty entry accumulation restarts from zero. Founding Member status, if applicable, is also permanently forfeited upon lapse.

While your membership remains in its paid period after cancellation (before lapse), your existing loyalty entries continue to apply to any Draw whose entry deadline falls within that period. Once your paid period ends and your account reverts to Tourist, all entries are excluded from any subsequent Draws.

Full details of entry mechanics, accumulation, and forfeiture are set out in Section 11 and in the Competition Terms.

9. Refunds

Membership fees are generally non-refundable. We do not provide refunds or credits for partial Billing Periods or for the unused portion of a Billing Period when you cancel. Because cancellation takes effect at the end of your current Billing Period, you continue to receive the full service for the period you have paid for.

Exceptions may be made at our sole discretion for:

  • Technical issues that prevented access to the Platform for an extended period
  • Billing errors or duplicate charges
  • Exceptional circumstances reviewed on a case-by-case basis

Nothing in this Section excludes, restricts, or modifies your rights under the Australian Consumer Law, including any right to a refund where our services fail to meet applicable consumer guarantees.

10. Upgrades and Downgrades

10.1 Upgrades

You may upgrade your membership tier at any time (Tourist to Regular Traveller, Regular Traveller to Seasoned Traveller, or Tourist to Seasoned Traveller). Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your current Billing Period. When you upgrade from Regular Traveller to Seasoned Traveller, your months of continuous membership are preserved: your existing loyalty entries are banked and the higher accrual rate (5 per month, capped at 60) applies from the upgrade date forward.

10.2 Downgrades

You may downgrade your membership tier at any time. Downgrades take effect at the end of your current Billing Period. No refunds or credits are provided for the price difference during the remainder of the current period. Upon downgrade, your loyalty entries are recalculated using the lower tier's accrual rate and cap.

10.3 Effect on Entries

Promotional entry counts are recalculated based on your tier at the time of each Draw's entry deadline. Changing tiers mid-month may affect your entry count for that month's Draws.

11. Promotional Entry System

This section summarises the promotional entry mechanics. Full rules, including eligibility, draw conduct, winner notification, and prize details, are set out in the Competition Terms.

11.1 Loyalty Entry Allocation

Paid members (Regular Traveller and Seasoned Traveller) automatically receive loyalty entries into Prize Draws based on their tier and months of continuous paid membership. No manual entry or action is required. Entries accumulate monthly as follows:

  • Regular Traveller Members: 1 entry per month of continuous membership, capped at 12
  • Seasoned Traveller Members: 5 entries per month of continuous membership, capped at 60
  • Founding Members: double the standard loyalty entries for their tier

Months of continuous membership are calculated as full thirty (30) day periods since the subscription start date or most recent reactivation date, with a minimum of one month for any active subscriber.

11.2 Additional Entry Sources

In addition to loyalty entries, Members may earn entries through the referral program (Section 13), subject to the rules set out in the Competition Terms. Entries cannot be purchased: draw entries are a free promotional benefit of paid membership.

11.3 Entry Cap

A Member's total entries in a single Draw, from all sources combined (loyalty accrual and referral bonuses), may not exceed one hundred (100).

11.4 Entry Forfeiture

Loyalty entries depend on holding an active paid membership at the Draw's entry deadline. If your membership lapses (i.e. your paid Billing Period ends and you have not renewed), your entries are excluded from all subsequent Draws and your loyalty accumulation resets to zero. There is no grace period for preserving accumulated tenure. If you re-subscribe after a lapse, your loyalty accrual restarts from month one.

12. Promotional Prize Draws

BookingClub conducts periodic promotional prize draws as a benefit for paid members. Each Draw is governed by the Competition Terms & Conditions, which are incorporated by reference into these Terms. In the event of any inconsistency between these Terms and the Competition Terms regarding draw conduct, eligibility, or prizes, the Competition Terms prevail.

Key points:

  • Only paid members (Regular Traveller and Seasoned Traveller) with an active membership at the entry deadline are eligible
  • Tourist (free) members do not receive entries and are not eligible for prizes
  • Draws are typically conducted monthly, with prizes valued at $4,950 AUD
  • Residents of the Australian Capital Territory and Western Australia are excluded from prize draws, as set out in the Competition Terms
  • Prize draws are a promotional benefit of membership, not the primary service
  • Members pay primarily for access to travel booking services and member benefits; draws are an added incentive

BookingClub reserves the right to modify, suspend, or cancel any Prize Draw in accordance with the Competition Terms.

13. Referral Program

The referral program is available to paid members only (Regular Traveller and Seasoned Traveller); it is not available on the free Tourist tier. Paid members may earn additional promotional entries by referring new paid members to BookingClub using their unique referral code. Referral bonus entries are awarded when the referred person completes a qualifying action (such as signing up, making a first purchase, or upgrading their tier).

Referral entries are allocated to the soonest upcoming Draw at the time the referral bonus is triggered. Referral entries are subject to monthly caps and abuse prevention measures. The following activities are prohibited and may result in forfeiture of referral entries and account termination:

  • Self-referrals (referring yourself using a separate account)
  • Coordinated or fraudulent referral schemes
  • Creating fake accounts to earn referral bonuses

BookingClub reserves the right to modify or discontinue the referral program, adjust referral bonus rates, or impose additional restrictions at any time with reasonable notice.

14. Travel Booking Services

This is an important section. Please read it carefully, as it explains how travel bookings work through BookingClub. Travel bookings are also governed by our Travel Booking Terms, which set out the full booking, payment, and cancellation process and prevail over this section to the extent of any inconsistency.

14.1 How Bookings Are Sourced

Travel booking services are provided by BookingClub. We source accommodation (hotels and similar properties) from wholesale accommodation suppliers through an independent travel technology platform. That platform is a technology provider; it does not itself supply the accommodation. BookingClub offers accommodation only. We do not sell flights, car hire, tours, or other travel products as member bookings.

14.2 The Accommodation

The accommodation is provided by the hotel or property you book. BookingClub arranges your booking with that property (through the wholesale supplier), takes your payment, and, where a refund is due under the rate's cancellation policy, returns it to you. The property remains responsible for the accommodation and any services it provides during your stay.

14.3 Booking Terms

Your travel bookings are governed by our Travel Booking Terms, presented at checkout, in addition to these Terms. By completing a booking you agree to those terms and to the cancellation policy shown for the rate you select.

14.4 Pricing and Availability

Travel prices displayed on the Platform reflect live wholesale rates together with any applicable membership pricing, and are subject to change without notice. All bookings are subject to availability and confirmation by the property. BookingClub does not guarantee the availability, accuracy, or currency of any pricing displayed until a booking is confirmed.

14.5 Booking Process and Your Responsibilities

You are responsible for:

  • Reviewing all booking details, including dates, guest names, room types, cancellation policies, and total cost, before confirming a booking
  • Ensuring all guest information is accurate and matches photo identification
  • Reading and understanding the cancellation policy applicable to your booking
  • Obtaining any necessary travel documentation, including valid passports, visas, health requirements, and travel insurance
  • Complying with all entry and exit requirements of your destination country or territory

BookingClub is not responsible for errors arising from incorrect information you provide, or for any consequences resulting from your failure to comply with a property's or destination's requirements.

14.6 Booking Cancellations, Changes, and Refunds

Each rate has its own cancellation policy, shown before you book and on your booking in the members area. Cancellations and refunds are governed by that policy. Where a refund is due under the policy, BookingClub processes it to your original payment method (typically within 5 to 10 business days). Refundable bookings can be cancelled by you from your booking in the members area. Non-refundable rates are not refunded once booked. Date or room changes are made by cancelling under the rate's policy and rebooking, and the price of the new booking may differ from your original booking.

14.7 Payment for Travel Bookings

Payment is taken by card at the time of booking. Your card is authorised first and charged once the property confirms your reservation; if the property cannot confirm, the authorisation is released and you are not charged. The charge may appear on your statement from our travel payment partner rather than under the BookingClub name. Currency conversion and any foreign transaction fees charged by your card issuer are your responsibility.

14.8 Travel Insurance

BookingClub strongly recommends that you obtain comprehensive travel insurance for all trips booked through the Platform. BookingClub does not provide travel insurance. Any travel insurance products or discounts referenced on the Platform are provided by third-party insurance providers and are subject to those providers' own terms, conditions, and eligibility requirements.

14.9 Travel Access by Tier

Access to the travel booking platform is available to all registered Members, including Tourist (free) tier members. Travel booking access is not restricted to paid tiers; paid tiers receive a bigger discounts on hotels.

14.10 Limitation of Liability for Travel

BookingClub is not liable for any loss, damage, injury, delay, cancellation, overbooking, strike, force majeure event, or any other event or circumstance arising from the accommodation or services provided by a property, except to the extent such liability cannot be excluded under the Australian Consumer Law.

Complaints about the accommodation itself, including service quality, property condition, or safety, are in the first instance a matter for the property. If you are unable to resolve a matter, you may contact us at concierge@bookingclub.com.au and we will use reasonable efforts to assist.

15. Advertising

The Tourist and Regular Traveller membership tiers include advertising from selected travel partners (such as travel insurance, mobile roaming, and luggage providers). These advertisements are clearly identified and may appear as banner placements within the member dashboard area.

Seasoned Traveller members enjoy a completely ad-free experience. No third-party advertising is displayed to Seasoned Traveller tier members.

BookingClub may also display internal promotional messages (such as upgrade prompts, referral program reminders, or upcoming draw notifications) to members of any tier. These are not third-party advertisements.

16. Account Responsibilities

16.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at concierge@bookingclub.com.au if you suspect any unauthorised access to or use of your account. You are responsible for all activities that occur under your account.

16.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update your information promptly if it changes. Providing false or misleading information may result in account suspension or termination, and may disqualify you from Prize Draws.

16.3 One Account Per Person

Each person may maintain only one active account. Membership accounts are personal and non-transferable. You may not share your account credentials with others, allow others to access your account, or transfer your membership to another person. Creating multiple accounts for any purpose, including to gain additional promotional entries, is strictly prohibited and may result in termination of all accounts without refund.

17. Acceptable Use

You agree not to engage in any of the following:

  • Creating multiple accounts to gain additional promotional entries or referral bonuses
  • Self-referrals, coordinated referral schemes, or any manipulation of the referral program
  • Attempting to manipulate, exploit, or circumvent the entry system, prize draw mechanics, or any other Platform feature
  • Using bots, scripts, or automated tools to access the Platform, create accounts, or interact with any Platform feature
  • Attempting to gain unauthorised access to other Members' accounts, BookingClub's systems, or connected networks
  • Uploading, transmitting, or distributing viruses, malware, or any harmful code
  • Harassing, threatening, or abusing other Members, BookingClub staff, or any third party through the Platform
  • Using the Platform for any illegal purpose or in violation of any applicable law
  • Scraping, harvesting, or collecting data from the Platform without our express written permission
  • Infringing on BookingClub's or any third party's intellectual property rights
  • Providing false information to qualify for prizes, Founding Member status, or other benefits

Violation of this Section may result in: a warning and requirement to cease the activity; temporary suspension of your account; permanent termination without refund; forfeiture of promotional entries and prize eligibility; disqualification from current and future Prize Draws; or legal action.

18. Intellectual Property

The Platform, including all content, features, functionality, software, text, graphics, logos, images, and trademarks, is owned by BookingClub or its licensors and is protected by Australian and international intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. This licence does not include any right to modify, copy, distribute, transmit, display, reproduce, publish, create derivative works from, or sell any content obtained from the Platform, or to use the Platform for commercial purposes or for the benefit of any third party.

"BookingClub," the BookingClub logo, and other BookingClub trademarks and service marks may not be used without our prior written permission.

19. Privacy and Communications

19.1 Privacy

Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, disclose, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Platform, you consent to our collection and use of your personal information as described in the Privacy Policy.

19.2 Data Sharing with Travel Partners

When you make a travel booking through the Platform, certain personal information (such as your name, contact details, and booking details) will be shared with the relevant Travel Supplier and the Travel Platform Provider to facilitate your booking. This sharing is necessary for the performance of the booking and is described in our Privacy Policy.

19.3 Communications

By creating an account, you consent to receive the following communications from BookingClub:

  • Transactional emails: account confirmations, payment receipts, subscription reminders, prize notifications, and draw results. These are essential to the operation of your membership and cannot be opted out of.
  • Service announcements: notifications about changes to the Platform, terms, policies, or membership benefits.
  • Marketing communications: newsletters, travel deals, promotions, and feature updates. You may opt out of marketing communications at any time by following the unsubscribe link in any email or adjusting your account preferences.

20. Service Availability

We strive to maintain continuous availability of the Platform but do not guarantee uninterrupted, secure, or error-free access. The Platform may be temporarily unavailable due to scheduled maintenance, updates, technical issues, or circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform, any membership tier, or any feature at any time. Where such changes materially affect paid membership benefits, we will provide at least thirty (30) days' notice.

BookingClub services are available only to Australian residents. Access to the Platform from outside Australia may be limited or unavailable.

21. Disclaimers and Limitation of Liability

21.1 "As Is" Disclaimer

The Platform and all services are provided "as is" and "as available" without warranties of any kind, either express or implied, except as required by law. BookingClub does not warrant that the Platform will be uninterrupted, secure, or error-free; that defects will be corrected; that the Platform or its servers are free of viruses or harmful components; that results obtained from the Platform will be accurate or reliable; or that you will win any prize in a Draw.

21.2 Third-Party Services

BookingClub is not responsible for the acts, omissions, or conduct of any third party, including the Travel Platform Provider, Travel Suppliers, payment processors, insurance providers, or advertising partners. Any disputes with third-party providers must be resolved directly with those providers.

21.3 Limitation of Liability

To the maximum extent permitted by law, BookingClub, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: your access to or use of or inability to access or use the Platform; any conduct or content of any third party on or through the Platform; unauthorised access, use, or alteration of your transmissions or content; travel services booked through the Platform; or failure to win prizes in promotional draws.

BookingClub's total aggregate liability to you for all claims arising from or related to these Terms or your use of the Platform shall not exceed the total amount you paid to BookingClub in membership subscription fees in the twelve (12) months immediately preceding the event giving rise to the claim.

22. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

If the Australian Consumer Law or any other applicable law implies a guarantee, condition, or warranty into these Terms that cannot be excluded, and BookingClub breaches that guarantee, condition, or warranty, BookingClub's liability is limited to (at our option):

  • In the case of services: supplying the services again, or payment of the cost of having the services supplied again
  • In the case of goods: replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of having the goods replaced or repaired

This limitation applies only to the extent permitted by the Australian Consumer Law.

23. Indemnification

You agree to indemnify, defend, and hold harmless BookingClub, its directors, officers, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from: your use of or inability to use the Platform; your violation of these Terms or any applicable law; your violation of any rights of any third party; any content you submit to the Platform; your travel bookings and related activities; or any fraudulent or illegal activity related to your account.

This indemnification obligation survives termination of these Terms and your membership.

24. Termination

24.1 Termination by You

You may terminate your membership at any time by cancelling your subscription in accordance with Section 8. If you are on the free Tourist tier, you may close your account by contacting concierge@bookingclub.com.au.

24.2 Termination by BookingClub

We may suspend or terminate your account immediately and without prior notice if you: violate these Terms, the Competition Terms, or any other BookingClub policy; engage in fraudulent, deceptive, or illegal activities; fail to pay membership fees after reasonable attempts to collect; create multiple accounts or manipulate the promotional entry, referral, or other systems; or engage in conduct that we reasonably determine is harmful to other Members, to BookingClub, or to third parties.

24.3 Effect of Termination

Upon termination (whether by you or by us), your right to access and use the Platform ceases immediately, except that if you have cancelled a paid membership, you retain access until the end of your paid Billing Period as described in Section 8.2. Termination does not relieve you of obligations incurred before termination, including any amounts owed. All accumulated promotional entries are forfeited upon termination.

25. Dispute Resolution and Governing Law

25.1 Informal Resolution

If you have a dispute or complaint relating to your membership or the Platform, please contact us first at concierge@bookingclub.com.au with a detailed description. We will attempt to resolve disputes informally within thirty (30) days of receiving your notice.

25.2 External Avenues

If you are not satisfied with our response, you may seek independent advice or contact relevant consumer protection authorities, including the Australian Competition and Consumer Commission (ACCC) at www.accc.gov.au or your state or territory fair trading body.

25.3 Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, for the resolution of any dispute arising from or related to these Terms.

25.4 Australian Consumer Law

Nothing in this Section excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable consumer protection legislation.

26. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to your registered email address and posted on the Platform with a new "Last updated" date at least thirty (30) days before taking effect.

Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your membership before they take effect. Changes do not apply retroactively.

27. General Provisions

27.1 Force Majeure

BookingClub shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, fire, floods, strikes, or failures of third-party services (including the Travel Platform Provider, payment processors, or hosting providers).

27.2 Assignment

You may not assign or transfer these Terms, your membership, or your account without our prior written consent. BookingClub may assign or transfer these Terms or any of its rights or obligations at any time, including in connection with a merger, acquisition, or sale of assets, with notice to you.

27.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

27.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorised representative of BookingClub.

27.5 Survival

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions.

27.6 Entire Agreement

These Terms, together with the Privacy Policy, Competition Terms & Conditions, Travel Booking Terms, Refund Policy, and any other policies expressly referenced in these Terms, constitute the entire agreement between you and BookingClub regarding your membership and use of the Platform, and supersede all prior agreements, representations, and understandings.

27.7 Headings

Section headings are for convenience of reference only and do not affect the interpretation or construction of these Terms.
